Federal appeals court strikes down Defense of Marriage Act

The Second U.S. Circuit Court of Appeals ruled in favor of Edith Windsor, an 83-year-old lesbian who sued the feds when she was charged more than $363,000 in estate taxes after she was denied the benefit of the deductions set aside for spouses. The court ruled that the law, which was passed in 1996, violates the equal protection clause of the Constitution.
Their 2-1 majority ruling upheld a lower court’s decision and determined that the gay population in the U.S. “has suffered a history of discrimination.”Article Source
